Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the SnapAPI.AI platform, website (snapapi.ai), API services, and all related services (collectively, the "Service") operated by SilverAI ("we", "us", "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

SnapAPI.AI is a unified API gateway that provides access to 40+ multimodal AI models through a single API endpoint. Our services include image generation, image processing, video generation, and chat completions powered by third-party AI model providers. We act as an intermediary, providing standardized access, uptime guarantees, and cost optimization for these models.

3. Account Registration and Security

To use the Service, you must create an account with a valid email address and accurate information. You are responsible for:

  • Maintaining the confidentiality of your account credentials and API keys
  • All activity that occurs under your account
  • Notifying us immediately at support@silverai.com if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. API Usage and Credits

4.1 Credits System

The Service operates on a prepaid credits system. You purchase credits in advance, and each API request consumes credits based on the model used and the complexity of the request.

4.2 Credit Packages

We offer various credit packages at different price points. Current pricing and available packages can be viewed on our Billing page. Prices are in US Dollars. Credit costs per API call vary by model and are detailed in our API documentation.

4.3 Credit Terms

  • Credits are non-transferable between accounts
  • Credits do not expire while your account remains active
  • Credits have no cash value and cannot be exchanged for currency
  • We reserve the right to modify credit pricing with 30 days advance notice

4.4 Rate Limits and Fair Usage

API usage is subject to rate limits based on your account tier. We reserve the right to throttle or restrict access if usage patterns indicate abuse, automated scraping, or activity that degrades service quality for other users.

5. Payment Terms

5.1 Payment Processor

All payments are processed by Creem (creem.io), which acts as our Merchant of Record (MoR). By making a purchase, you also agree to Creem's terms of service and privacy policy available at creem.io.

5.2 Payment Processing

Creem handles all payment processing, tax compliance (VAT, GST, sales tax), currency conversion, and invoice generation. SnapAPI.AI does not directly collect or store your payment card details.

5.3 Pricing and Taxes

All prices listed are inclusive of applicable taxes. Creem calculates and remits taxes to the appropriate authorities based on your location. The final amount charged may include applicable taxes as determined by Creem.

5.4 Currency

All credit packages are priced in US Dollars (USD). If you pay in a different currency, Creem will handle the conversion at prevailing exchange rates.

6. Refund Policy

  • Refund requests must be submitted to support@silverai.com within 14 days of purchase
  • Refunds are only available for unused credits
  • Credits that have been partially or fully consumed are not eligible for refund
  • Refunds are processed through Creem and will be returned to the original payment method
  • Processing time for refunds is typically 5-10 business days depending on your payment provider

7. Prohibited Uses

You agree not to use the Service to:

  • Generate, distribute, or store Not Safe For Work (NSFW), sexually explicit, pornographic, or suggestive content (including semi-nude, suggestive poses, or "uncensored" material)
  • Generate child sexual abuse material (CSAM) or any content exploiting minors
  • Create content intended for harassment, stalking, or intimidation of any person
  • Conduct fraud, phishing, or any deceptive practices
  • Generate malware, viruses, or other harmful software code
  • Violate the intellectual property rights of any third party
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell or redistribute API access without our express written permission
  • Bypass or attempt to circumvent rate limits, authentication, or security measures
  • Use the Service in a manner that violates any applicable law or regulation

We reserve the right to immediately suspend or terminate your account for any violation of these prohibited uses without prior notice.

8. Content Safety and Moderation

8.1 NSFW Prohibition

SnapAPI.AI maintains a strict zero-tolerance policy regarding Not Safe For Work (NSFW) content. You are expressly prohibited from using our Service to generate, process, or distribute sexually explicit, pornographic, or sexually suggestive content.

8.2 Moderation Filters

To ensure compliance with our safety standards and those of our upstream providers and payment partners, we implement automated content moderation filters. These filters are designed to detect and block the generation of prohibited content. Attempting to bypass these filters is a material breach of these Terms.

8.3 Enforcement

We monitor API usage for patterns of abuse. If we detect attempts to generate prohibited content, we may:

  • Block the specific request
  • Issue a warning
  • Suspend or permanently terminate your account
  • Report illegal content (such as CSAM) to the appropriate authorities

9. Intellectual Property

9.1 Our Property

The SnapAPI.AI name, logo, website design, documentation, and all related branding are the property of SilverAI. You may not use our trademarks without prior written permission.

9.2 Your Content

You retain ownership of the input data you submit to the Service and any output generated from your inputs, subject to any applicable restrictions from the underlying AI model providers.

9.3 Model Provider Terms

AI-generated outputs may be subject to additional terms and conditions set by the underlying model providers. We recommend reviewing the usage terms of specific models you use through our documentation.

10. Third-Party AI Models

SnapAPI.AI provides access to AI models developed and maintained by third-party providers. We do not control and are not responsible for:

  • The accuracy, quality, or reliability of model outputs
  • Changes to model behavior, capabilities, or availability made by model providers
  • Content filtering or safety mechanisms implemented by model providers

Models may be updated, deprecated, or removed from the Service at any time based on availability from upstream providers. We will make reasonable efforts to provide advance notice when models are removed.

11. Service Availability and SLA

We target 99.9% uptime for the Service. However, this is not a guarantee. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Unplanned outages or technical issues
  • Third-party service disruptions
  • Force majeure events

12. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability for any claims arising from or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption
  • We are not liable for the accuracy, quality, or appropriateness of any AI-generated output

13. Termination

13.1 By You

You may terminate your account at any time by contacting support@silverai.com. Upon termination, unused credits will be handled per our Refund Policy (Section 6).

13.2 By Us

We may suspend or terminate your account immediately if you violate these Terms, engage in prohibited uses, or if we are required to do so by law. We may also terminate the Service entirely with 90 days advance notice.

13.3 Survival

Sections relating to Intellectual Property, Limitation of Liability, and Governing Law shall survive termination of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the appropriate courts of competent jurisdiction.
